To what extent should states accommodate religious liberty claims? Can the pluralist state be neutral between religions and secularism? This book explores contemporary legal controversies regarding the protection of religious liberty from a theoretical and comparative perspective, looking at issues such as family and parenting, medical treatment, education, employment, religious group autonomy, and freedom of expression.

This article argues that secularism is not neutral. Secularization is a process, the secular state is a structure, whereas secularism is a political philosophy. Secularism takes two main forms: first, a “benevolent” secularism that endeavours to treat all religious and nonreligious belief systems even-handedly, and, second, a “hostile” kind that privileges unbelief and excludes religion from the public sphere. I analyze the European Court of Human Rights decision in Lautsi v Italy, which illustrates these types. The article concludes that secularism (...) as a political philosophy cannot be neutral, and the secular state is not neutral in its effects, standpoint, governing assumptions or treatment of religious truth claims. This article explores the recurrent global claim by indigenous peoples for their spiritual concerns to be taken seriously and given appropriate effect in public policy. The secular liberal state's commitment to ideals of religious neutrality and equal treatment of all faiths and none is clearly tested to the degree it privileges traditional indigenous religion in the name of fostering indigenous culture. This dilemma has been acutely raised in New Zealand where Maori metaphysical concerns—the appeasement of taniwha (spiritual monsters) and the (...) evils of mingling the mauri (life-force) of human and non-human species in genetic engineering—have been subjected to judicial scrutiny. Quite apart from issues of justiciability, the legal acknowledgment of indigenous spirituality raises questions about the continued secularity of the state. This essay traverses the varying responses to indigenous spirituality, especially criticisms that such recognition constitutes government countenancing of primitive superstition, a fostering of paganism or naked religious favouritism. Here we review 37 modern neuroimaging studies in an attempt to address this question posed by Halstead (1947) as he and other icons of the last century endeavored to understand how brain and behavior are linked through the expression of intelligence and reason. Reviewing studies from functional (i.e., functional magnetic resonance imaging, positron emission tomography) and structural (i.e., magnetic resonance spectroscopy, diffusion tensor imaging, voxel-based morphometry) neuroimaging paradigms, we report a striking consensus suggesting that variations in a distributed network predict (...) individual differences found on intelligence and reasoning tasks. We describe this network as the Parieto-Frontal Integration Theory (P-FIT). The P-FIT model includes, by Brodmann areas (BAs): the dorsolateral prefrontal cortex (BAs 6, 9, 10, 45, 46, 47), the inferior (BAs 39, 40) and superior (BA 7) parietal lobule, the anterior cingulate (BA 32), and regions within the temporal (BAs 21, 37) and occipital (BAs 18, 19) lobes. White matter regions (i.e., arcuate fasciculus) are also implicated. The P-FIT is examined in light of findings from human lesion studies, including missile wounds, frontal lobotomy/leukotomy, temporal lobectomy, and lesions resulting in damage to the language network (e.g., aphasia), as well as findings from imaging research identifying brain regions under significant genetic control. Overall, we conclude that modern neuroimaging techniques are beginning to articulate a biology of intelligence. We propose that the P-FIT provides a parsimonious account for many of the empirical observations, to date, which relate individual differences in intelligence test scores to variations in brain structure and function. Moreover, the model provides a framework for testing new hypotheses in future experimental designs. (shrink)

The commentaries address conceptual issues ranging from our narrow focus on neuroimaging to the various definitions of intelligence. The integration of the P-FIT and data from cognitive neuroscience is particularly important and considerable consistency is found. Overall, the commentaries affirm that advances in neuroscience techniques have caused intelligence research to enter a new phase. The P-FIT is recognized as a reasonable empirical framework to test hypotheses about the relationship of brain structure and function with intelligence and reasoning.

In the first section of this paper, I articulate Jaegwon Kim's argument against emergent down ward causation. In the second section, I canvas four responses to Kim's argument and argue that each fails. In the third section, I show that emergent downward causation does not, contra Kim, entail overdetermination. I argue that supervenience of emergent upon base properties is not sufficient for nomological causal relationsbetween emergent and base properties. What sustains Kim's argument is rather the claim that emergent properties realized (...) by base properties can have no causal powers distinct from those base properties. I argue that this is false. The notion of rule utilitarianism (a twentieth-century addition to the canon of utilitarian thought) has been discussed under two main headings—ideal-rule utilitarianism and 'indirect' utilitarianism. The distinction between them is often hazy. But we can sketch out each perspective along three different dimensions, contrasting the two conceptions of rule utilitarianism at each of three main hinge points: (1) the grounding of rules, (2) the allowed complexity of rules, (3) the conflict of rules. These two profiles constitute ideal types, but they (...) help us see that we can regiment and focus utilitarian intuitions in two quite distinct ways. An interesting test case is provided by J.S. Mill. He has been associated with each of these perspectives (with a utilitarianism of ideal rules by R.B. Brandt and with indirect utilitarianism by John Gray), but careful attention to Mill's main arguments indicates, I believe, that he adheres to neither consistently, though he is closer to the indirect utilitarian position. This carefully crafted volume concludes the series of works that began with Cultural Thematics. Seung's primary aim is to go beyond the malaise of post-New Critical studies and to reinstate the centrality of contextual understanding in the interpretation of the structure and meaning of a text. In his introductory discussion of "Text and Context" the author undermines the claims of the objectivity of a text, textual solipsism and textual agnosticism in a manner that recalls the previous arguments in philosophy concerning (...) our knowledge of the external world. Starting with an analysis of textual indeterminacy, Seung ranges over a variety of relevant conceptions of the interpretation of a text, touching upon the works of E. D. Hirsch, Schleiermacher, Cleanth Brooks, Dilthey, Gadamer, and others. In a fairly technical chapter, "Semantics and Pragmatics," the distinctions between formal semantics and informal pragmatics are clearly discussed. An analysis of the pragmatic use of language leads to detailed and informative discussions of pragmatic norms, pragmatic functions, and the relevance of authorial intention for an understanding of a given text. Simplifying Seung's lucid and disciplined arguments, it is shown that a proper understanding of a text requires a grasp of the holistic culture in which it is presented, as well as an understanding of regnant cultural themes. Enriched by interpretations of the Odyssey, Oedipus Rex, the Aeneid, Dante's Commedia, and other literary works, Seung displays the art of contextual interpretation in accordance with his own principles. Of special interest is the presentation of the importance of textual coherence for significant textual interpretations. The various analyses of the role of thematics in the understanding of literature in historical context lead to sympathetic appraisals of Gadamer's hermeneutic program and a brief defence of Gadamer against the charge of falling into an historicist relativity. Finally, Seung concludes his illuminating study with a sketch of a cultural morphology that resembles, in embryo, Hegel's phenomenology of culture. This is no accident, insofar as Seung presents, in his concluding outline of the interaction of cultural themes, an admitted variation on Hegel's dialectical theme. By even finding a place for the "existential dimension of thematic dialectic," the author manages to negate and preserve the solipsism of the reader and give recognition virtually to every relevant aspect of a complex hermeneutic process.--G. Ayer (1910-89) had the misfortune, for a philosopher, to write his most influential book, Language, Truth, and Logic, when he was in his twenties, even though he continued to publish into his seventies, and to have (...) his nonphilosophical life overwhelm his philosophical one. Almost everyone now knows the story of how he saved Naomi Campbell by going a round with Mike Tyson. Ben Rogers nicely intertwines the facts of Ayer's day-to-day life—which is not to say "quotidian," given Ayer's ego and libido—with his philosophical peregrinations.Although Ayer picked up logical positivism in Vienna when attending sessions of the Vienna Circle, he had accepted the main lines of an empiricism and positivism earlier and on his own. For twentieth-century British philosophy, Language, Truth, and Logic was both a philosophical Declaration of Independence (from metaphysics) and the Constitution for a new philosophy. Unfortunately, its founding principle, the principle of verifiability, was irremediably flawed, notwithstanding Ayer's best efforts, notably in the Preface to the second edition of 1946. Logical positivism in Britain lasted for only about a decade (1935-46). In fact, it may have been less. Language, Truth, and Logic was published in 1936, and Ayer "went off to war" in 1940, to speak loosely. (He spent a significant part of it in a Mediterranean villa, a Park Avenue apartment, "a palatial home" in Paris lent him by Guy de Rothschild, and in the best restaurants with friendly women.) No major British philosopher was championing Logical Positivism between 1940 and 1945. When Ayer returned to Oxford in 1945, he discovered that "the [philosophical] climate had changed; before the conflict he had been the leader of the avant-garde; now the brighter students and the young dons looked on logical positivism as old hat. He had mysteriously passed "from being a young Turk to being, at the age of thirty-five, to almost an elder statesman, without ever having known the plenitude of office'" (198). During the late 1940's, Ayer wrote mostly for London literary and arts magazines. The profession of philosophy disappointed him, and later, he found it difficult to keep up "in logic and the philosophy of maths and sciences" (262).Logical positivism had a longer life in North America, to which several of its members emigrated. But its influence was felt much longer in both places, primarily for its emphasis on three things: empiricism, empiricism, empiricism.Ayer continued to publish philosophy until the mid-1980s. Given the demise of logical positivism, he was something of a dinosaur, albeit a Tyrannosaurus Rex. There was no one else quite like him, and yet he could not be ignored. He was a formidable critic of whatever most other British philosophers were doing. In addition to his obvious intellectual brilliance, he was an excellent writer and expositor. After 1970, most of his books are potboilers, skillful in execution, but of no lasting merit, for example, Russell and Moore (1971), Russell (1972), Hume (1980), and Wittgenstein (1985). Wind turbine noise is annoying and has been linked to increased levels of psychological distress, stress, difficulty falling asleep, and sleep interruption. For these reasons, there is a need for competently designed noise standards to safeguard community health and well-being. The authors identify key considerations for the development of wind turbine noise standards, which emphasize a more social and humanistic approach to the assessment of new energy technologies in society.
